The end of the contract for bad behavior of the childcare assistant.

This is the kind of case that you don't even considering happening to you, the safety of your child was put in jeopardy and you won't accept it. This type of termination is immediate, you do not give any notice.

This kind of termination may be due to negligence or abuse of your child.

Termination for misconduct.

This includes all the shortcomings regarding the welfare and safety of a child while in the care of the in-home childcare provider. This may involve repetitive negligence during the care and supervision of the child or worse, the suspicion of abuse.

Serious misconduct may also be an action that goes against what was agreed upon in the contract.
For example: you did not give your childcare provider permission to go shopping with your child and your neighbour has seen them three times this month at the department store. 

The procedure for firing your childcare assistant.

  •  In this case the letter of dismissal for serious misconduct should be very explicit and should detail the reasons for the dismissal.
  • Notice: termination for misconduct, wilful or gross, negayes the need to provide advanced notice.
  • The date of termination: will be specified in the letter of termination (often effective immediately). 
  Compensation for breach of contract is not required.

Serious misconduct

It is rare in the profession, but it can be necessary to prove that the caregiver wanted to deliberately undermine the parents.

  Termination must follow the Employment Standards Act :
  • No notice or compensation is required in cases that clearly display extreme dishonesty, insubordination or incompetence,
