My nanny wants to take her vacation
It is you, as an employer who must arrange your nanny's vacation time.
One doesn't just have to agree on dates (and this is sometimes complicated enough!).
In addition, it is your responsibility as an employer that your nanny take her leave (in most provinces this is mandatory). We expect you to count the days used and the days that remain.
How to set the vacation dates for your nanny?
Who sets the vacation dates?
Usually the nanny will request the dates that she would like to take her vacation, of course this doesn't mean that you have to approve them. It may not be possible for you. If both you and the nanny can agree to take your vacation at the same time; it is preferable. Once agreed upon, it's not a bad idea to put it in writing, in the case of a disagreement.
When to set the vacation dates?
Well that's up to you! However, there are some rules. For example, you cannot ask your nanny to use one day of vacation every month, the minimum length depends on your provincial standards.
Division of vacation days
Most provinces have limitations on the way you divide up your employee's vacation time. For example, in Saskatchewan, employees are entitled to take all of their annual vacation at once and in B.C. vacation time cannot be divided into periods shorter than one week.
At what point has the nanny "earned" her vacation?
Vacation time is due to the employee after the first 12 months of employment although not all employers are as strict about this and let their employees take vacation during the first year.
Part time employees have the same right to vacation as full time employees, the only difference lies in the calculation of vacation pay which you will read about on the next page.
Warning: you can not make up the days of vacation not taken by the payment of a sum of money. In most provinces vacation time is mandatory. Employees cannot work through their vacation time in order to earn more money. For more info, check out this page
