Among the special events that you might experience during home childcare, the pregnancy of your nanny will have major consequences for you and your child because it includes a long absence. In addition to replacing your nanny, you will manage the administrative side of her leave, and remain alert to the protective treatment granted to any pregnant woman.
Due to her pregnancy, your nanny maybe be absent:
- occasionally for doctor's visits if they cannot be scheduled outside of working hours
- during her maternity leave
- during her parental leave
You may also wish to discuss with your nanny her plans for her child once she returns to work. Will she put him in a daycare or perhaps she would like to bring him to work? This is something that should be discussed between you and the nanny.
You are not responsible for paying your nanny's salary while she is on maternity and/or parental leave. The nanny can apply for these benefits through the EI system.
If you must fire your nanny during her pregnancy, take care that:
- the reason is not related to her pregnancy
- the dismissal is absolutely necessary.
In the case where your nanny doesn't want to return to work after her pregnancy the easiest thing to do is to ask her to resign. If she does not, you can consider after formal termination for abandonment of employment.
During your nanny's maternity leave, you can hire a new nanny on a fixed-term contract. The problem for you is the establishment of a new contract and new adaptation period. ...
