Your childcare provider has lost her license.

You just found out! Your childcare professional has just received a letter notifying her that she has lost her license, it is one of the possibilities of the breach of contract.

Home childcare providers can care for a number of children without a license (this numbers varies from one province to another), so she may still legally be able to care for your child. However, you may want to consider the reason why she lost (or did not renew) her license.

The reasons for a loss of license.

There could be many different explanations for why your childcare provider has lost her license but none of them are good. 

Some requirements for childcare may lead to multiple inspections to ensure that the childcare provider's residence is brought into conformity on specific points of safety.
Some examples:
  • the lack of a safety barrier down the stairs,
  • no or insufficient smoke-detectors 
 If work requested has not been made within the time limit, she can be given a suspension of her license.

When the childminder is suspended, she prohibition to accept children until reinspected by the acting provincial authorities.
Other examples where a licensed caregiver may be suspended:

  • health of the childcare provider,
  • physical abuse, 
  • child left unsupervised, alone,
  • unreported income,
  • presence of a dangerous dog, for example..

Terminating your childcare provider over loss of license.

  • The letter of termination should include a sentence explaining that you are removing the child from care and breaching the contact due to the repeal of the carer's license.
  • For licensed care no notice or severance payment is required when the provider loses her license. The date of termination will be that of the suspension or withdrawal of approval.
  •  A license is not required for in-home care providers who care for a minimum number of children (depending on the province), however a licensed care provider is preferable over a non-licensed one.  This article features some food for thought about unlicensed daycares.
