My nanny is off work due to illness

Your nanny is sick and can not come and watch your child. This exceptional event unfortunately occasionally occurs when you employ a nanny! Once the problem of finding a temporary replacement (find a emergency nanny on top-nanny!  ), you must manage the nanny's sick leave. 
If you have agreed to paid sick days in the contract the nanny will of course use those days. Alternatively employees are eligible for a certain number of unpaid sick days depending on the province, usually between 3-5 per year. 


If your nanny needs to take an extended sick leave you cannot terminate her for being ill.

Does the nanny have to prove her illness?

Generally if an employee is sick for a couple of days an employer does not ask for a doctor's note although you can request one. For an extended medical leave you can expect written proof of her illness and an approximate duration of her leave.

How will the nanny be paid during her sick leave?

You do not pay the nanny during her sick leave (outside of any paid sick days agreed upon in the contract), but your employee may be eligible for sick benefits through EI.

Attesting for your nanny's leave

If your nanny is on an extended sick leave she may apply for EI sick benefits. This requires her to provide the employer's contact details as well as the hours worked and her insurable earnings in the past 52 week period in addition to proof of her illness.

You may be contacted by Service Canada to verify this information. Be as helpful as you can as this will help your nanny to receive her sick benefits.
