Other time-off or leaves of absence: am I require to pay them?

Apart from her paid vacation your nanny may be absent for various reasons.

Most of these various leaves of absence are unpaid. In the case of certain types of leave, such as maternity leave, the employer is not responsible for paying these benefits. Maternity leave benefits are paid out by the Employment Insurance system. 

If the employee follows the correct procedures such as giving appropriate notice and not going over the number of day allowed, you cannot fire an employee for taking leave.

If you have included paid sick days in your contract you will be required to pay your nanny if she is unable to work due to illness. Marie-Helene, lawyer and contributor to Her Magazine suggests that offering the nanny a few paid sick days per year "encourages employee loyalty" (read the full article here).

Different types of absences:

Absence for personal reasons: 
Upon request your nanny can ask for time off for personal reasons such as maternity leave or for illness or injury, unless personal days or sick days are agreed upon in the contract (not a bad idea  ), these absences are unpaid. The length of time permitted is set at the provincial level.

Absence for family situations:
Your nanny may ask for leave in the case of a death of a family member (bereavement leave), in order to take care of a critically ill family member or sick child. This leave is not paid for by the employer.

 Federal requirements:
  • Maternity and parental leave of up to 52 weeks for the birthmother (eligible after 6 months of employment),
  • Illness or injury leave of up to 12 weeks (eligible after 3 months of employment),
  • Compassionate care leave to take care of a gravely ill family member, up to 8 weeks,
  • Bereavement leave following the death of a family member, up to 3 days (eligible after 3 months of employment).
Provincial guidelines:
  • Number of sick days and other types of leave are regulated on the provincial level.

Leave must be taken in the days surrounding the event, with your agreement and in some cases may require advanced notice. 

  Employees may be eligible for benefits during time off. Benefits such as maternity leave are paid to eligible recipients through the EI system. Employers are not responsible for paying maternity benefits.
